The Ministry of Attorney General in BC is developing a proposal regarding prompt payment in the construction sector.
Prompt payment legislation has been enacted in most other Canadian jurisdictions. Its purpose is to address payment delay in the construction industry which has a disproportionate impact on small businesses in the industry such as equipment and material suppliers, contractors, and subcontractors.
Consistent with the legislation seen elsewhere in Canada, a legislative proposal for legislation in BC would introduce requirements for payment within certain specific timelines down the construction chain, and would also create an adjudication authority and processes to enable faster and more accessible resolution of payment-related disputes.
