WHEREAS under provision of the Local Government Act parkland dedication is not required for a phased strata plan application under the Strata Property Act: THEREFORE BE IT RESOLVED that the provincial government amend the provisions of the Local Government Act andor the Strata Property Act to require parkland dedication as a condition of any phased strata plan approval under the Strata Property Act, including a phased strata approval.

Ministry of Community Services The 5 parkland dedication provision in s. 941 of the Local Government Act currently applies to bare land stratas whether phased or not, but not to building stratas. In addition to the statutory 5 parkland dedication requirement, local councils and boards have the authority to require developers to contribute land or money to their park systems under their development cost charge powers in sections 933 and 936. These charges can be applied to building stratas if the local government wishes to do so. It is not clear that it would be appropriate to impose a 5 charge on the construction of condominiums but not on apartment buildings. Staff will review the appropriateness of legislative change. The review could include consultation with UBCM and with the representatives of the development industry and other affected interests.
