WHEREAS land use is a local government responsibility under provincial statutory authority; AND WHEREAS aerodromes, airstrips and heliports have been deemed by the Courts to be a federal jurisdictional matter and not available for regulation or prohibition by local government: THEREFORE BE IT RESOLVED that the Union of British Columbia Municipalities and the Federation of Canadian Municipalities encourage the federal government to either actively pursue its responsibility for all aspects of land use relative to aeronautics, or acknowledge this as a jurisdiction of those local governments requesting such jurisdiction.

TRANSPORT CANADA Response to FCM conveyance Liberal Government In light of the federal jurisdiction relative to aeronautics, Transport Canada encourages the aviation industry to engage in local consultation in areas of mutual interest. Promotion of a good neighbour policy is advantageous to all concerned. Effective relationships can be established and strengthened through such a policy. Transport Canada respects the role that provincial governments play with respect to land use and liaises with these governments on all land use questions. As in the past, Transport Canada will continue to coordinate its land use initiatives with provincial governments and organizations such as the Federation of Canadian Municipalities.

FEDERATION OF CANADIAN MUNICIPALITIES This resolution was discussed in September 2005 by the FCM National Board of Directors. It was adopted as a Category A resolution NTC05.3.02CA and was conveyed to the federal Minister of Transport.
