Decision on UBCM Participation in Jumbo Case

The Executive of UBCM has decided not to become involved in a case before Supreme Court of British Columbia regarding the creation of the Jumbo Glacier Mountain Resort Municipality.

On Feb 18, 2013, the West Kootenay EcoSociety submitted an application for a judicial review of the incorporation of the Jumbo Glacier Mountain. At its April meeting, UBCM Executive reviewed the background on this petition, and examined UBCM's policy and legal options to determine a response.

The primary reason for UBCM's decision to not include itself in the case is that the petitioner is not a local government. In addition, no UBCM members, including the Regional District in which the new resort municipality is situated, have opted to become involved in this proceeding before the Court.

During the course of reviewing this matter with our lawyer, UBCM concluded that the consultation undertaken by the Province with UBCM regarding Bill 41 (which amended the Local Government Act with regard to the incorporation of mountain resort municipalities) was inadequate. President Sjostrom has written to the Minister of Community, Sport and Cultural Development to express UBCM's concerns with the Province's consultation with regard to Bill 41.
